Résumé de la décision

TSSA has completed an online consultation on the Code Adoption Document (CAD) amendments for Fuel Oil. The CAD was published on October 12th, 2021 and effective Dec. 12th, 2021.

The Fuel Oil CAD is adopted by reference in Ontario Regulation 213/01. TSSA will adopt the 2019 edition of CSA B139 series 19 Code, as well as CSA B138.1 and B138.2 (2017

TSSA would like to thank all individuals who participated in the consultation. There were 568 visitors to the consultation web page, 131 visitors reviewed or downloaded the attached documents, and 30 individuals submitted responses via the web page and email. In addition, TSSA posted the draft CAD on the Ontario Environmental Registry. There was 1 comment received through that process.

TSSA reviewed and analyzed the range of comments that were received. Comments focused on environmental concerns, technology, and reducing current amendments not directly tied to safety outcomes. TSSA’s final CAD amendments were guided by an analysis of evidence, national code considerations (current and future), and its overall safety mandate. Stakeholder feedback that did not align with these principles was not accepted in the final version of the CAD amendments. TSSA encourages stakeholders to propose changes to the national code committees for consideration in future editions.

TSSA is publishing the Fuel Oil CAD with three new amendments and additional minor changes based on the feedback from the consultation.

The three amendments include the acceptance of press connect fittings, exempting packaged generators from certain clearance rules, and removing the requirement for a 90-day limit on portable generators. In addition, TSSA has established a five-year transition period for portable generators to come into compliance with the editions of B138.1 and B138.2 in effect in Ontario at the time.

Amendments to Fuel Oil Code Adoption Document (CAD) 2020

The Fuel Oil CAD is adopted by reference in Ontario Regulation 213/01 (O. Reg 213/01). The regulation applies to equipment where fuel oil is used as a fuel in the Province of Ontario. The CAD adopts a series of national safety codes into regulation.

National codes

TSSA proposes to adopt the latest edition (2019 editions) of CSA B139 series codes published by the Canadian Standards Association. The B139 series is arranged into four parts:

  • CSA B139.1.0 covers general requirements for large installations;
  • CSA B139.1.1 covers general requirements for stationary oil-burning engine installations;
  • CSA B139.1.2 covers general requirements for special oil-burning equipment installations; and
  • CSA B139.2 covers general requirements for residential and small commercial building installations.

TSSA’s codes

As part of the Fuel Oil CAD amendments, TSSA has also updated the Field Approval Code (FAC) adopted by reference in the CAD. This code establishes the requirements for approval of appliances that are custom-made, built on site or produced in limited numbers.

The summary below highlights the notable changes from the latest editions of the codes that affect the safe operation of fuel oil equipment.

  • New requirement added limiting the acceptance of tanks conforming to the American Petroleum Institute standard 650 for storage tanks (API 650) to field erected tanks with capacities that exceed 175,000 L
  • New requirements added for through-the-wall venting for condensing appliances
TSSA-Field Approval Code 2020
  • Adopts the 2020 edition of CSA B149.3 code
  • Adopts the 2019 edition of National Fire Protection Association 85 (NFPA 85) and NFPA 86 standards

In this version of CAD, TSSA has removed 28 out of 55 existing Ontario-specific amendments in the Fuel Oil CAD and added one new Ontario-specific amendment. In total 28 Ontario-specific changes will continue to be enforced. Below is the change log.
