Update Announcement

This notice was updated on July 21, 2023 to advise the public that this proposal has been referred by the Niagara Escarpment Commission to the Ontario Land Tribunal (OLT). It is anticipated that the Ontario Land Tribunal will consolidate a hearing on this matter with the appeals the applicant has filed under OLT case numbers OLT-22-004372 (City of Burlington), OLT-22-0486 (Region of Halton), and OLT-22-04888 (Ministry of Natural Resources and Forestry). No additional opportunity for comment is being provided for at this time. Application for Party or Participant status at the anticipated consolidated hearing may be made to the OLT (www.olt.gov.on.ca)

This notice was updated on January 23, 2023 to advise the public that there has been no change to the status of this proposal, and it is still being considered. No additional opportunity for comment is being provided for at this time.

Proposal update

On March 4, 2021 we updated this proposal in the public consultation opportunities section to advise of which newspapers this application to amend the Niagara Escarpment Plan has been advertised.

Proposal details

The application proposes to change the land use designation of approximately 78.3 ha (193.5 ac.) of lands from the Escarpment Rural Area designation to the Mineral Resource Extraction Area designation to facilitate an expansion to an existing aggregate extraction operation.

Nelson Aggregate Co. application also proposes to apply a site specific special policy to the existing extraction site to allow for the continuation of aggregate processing operations in conjunction with the proposed expansion.

The amendment would facilitate a below-water aggregate extraction operation that will extract approximately 50.2 ha (124.0 ac.) of the 78.3 ha (193.5 ac.) of land proposed to be redesignated to Mineral Resource Extraction Area. The proposed expansion lands are estimated to contain ±30 million tonnes of mineral aggregate resource.

The amendment would also facilitate the continued use of the existing aggregate processing and maintenance facilities on the current Nelson Aggregate Co. site in the processing of material extracted from the proposed expansion lands.

Other information 

Nelson Aggregate Co’s current licence at the Burlington Quarry spans 218.3 ha with an extraction area of 210.0 ha. The site also contains offices, maintenance facilities, an asphalt plant, recycling operations, and other facilities utilized in the extraction and production of aggregate materials.

Nelson Aggregate Co. intends to continue to utilize these facilities in tandem with the expansion lands and has proposed a site-specific policy be applied to recognize their future use.

Public consultation opportunities

A notice regarding the application has been posted in the Burlington Post and the Milton Canadian Champion newspapers.

Information has been posted on the website of the Niagara Escarpment Commission (NEC) please visit the site here to comment on the proposal.

A notice sign will be posted on the properties so that the local public is notified that an application has been submitted and advised who to contact for more information or to submit comments.

Pursuant to the Niagara Escarpment Planning and Development Act, a public meeting may be held.

NEC offices remain closed. All application materials are available on the City of Burlington website, the Region of Halton website, and the proponent’s website.
