On September 15, 2021 we approved a new Environmental Compliance Approval (private sewage) No. 0062-C2FJPS for the establishment and use of a domestic wastewater treatment system at 310 Talbot Road East, Leamington.
The total proposed daily design process wastewater flow generated by the greenhouse work camp is 24,750 litres per day. The approved sewage works for domestic wastewater treatment include:
- one class 4 system for the existing residence
- one existing grease interceptor for the existing bunkhouse
- one existing 29,500 litres septic tank for the existing bunkhouse
- one existing 9,100 litres pump chamber for the existing bunkhouse
- one existing 18,200 litres Waterloo Biofilter for the existing bunkhouse
- one existing 9,100 litres septic tank for the existing greenhouse
- one existing 4,500 litres pump chamber for the existing greenhouse
- flow measurement devices located at the inlets and the outlets of the treatment system
- one 4,050 litres grease interceptor for the new bunkhouse
- one 14,200 litres equalization tank
- one 29,400 litres online sludge storage tank / primary clarifier
- two moving bed bioreactors in series (7,000 litres and 6,500 litres respectively)
- one 2,400 litres flocculation tank with a phosphorus removal chemical storage tank and dosing
- one secondary clarifier
- one 4,400 litres intermediate pump tank
- one filter cell with an automatic backwash system
- two UV disinfection systems in series
- one 8,600 litres final pump tank
- one raised Type A dispersal bed with a total sand contact area of 2,175 square meters
- one existing raised Type A dispersal bed with a total sand contact area of 750 square meters
- one cutoff wall on the eastern property line
- one contaminant attenuation zone located at 302 Talbot Street East, Leamington
The treated wastewater meeting the ministry's effluent requirements will discharge into the subsurface.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for a new Environmental Compliance Approval (ECA) to expand existing subsurface disposal works (previously approved by the Municipality of Leamington under the Ontario Building Code) to service a proposed expanded greenhouse complex (i.e. greenhouse and bunkhouse), located at 310 Talbot Street East (County Road 34) in the Municipality of Leamington.
The expanded sewage works include:
- existing and new grease interceptor tanks
- an existing Waterloo Biofilter trickling filter treatment system
- a new flow equalization tank
- a new iQ.MBBR moving bed biofilm reactor treatment system (with ammonia reduction, phosphorous reduction, and disinfection),
- existing and new Type A dispersal beds
The peak daily design sewage flow is approximately 17,550 litres per day.
