Pourquoi une consultation n’est pas nécessaire
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR .
Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on May 5, 2020 while Ontario Regulation 115/20 was in effect.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1733 for public comment from May 5, 2020 - June 19, 2020 (45 days). To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision
A new Environmental Compliance Approval (air & noise) has been issued to King Concrete Recycling Inc. for the operation of a mobile crushing plant, equipped with a crusher, a screener, a stacker and associated diesel engines. The equipment will be used to process concrete aggregate throughout the Province of Ontario.
The equipment will be used to process concrete aggregate throughout the Province of Ontario and can potentially operate 24 hours per day, seven days per week, and 52 weeks per year.
Contaminant emissions to the air from this facility include total suspended particulate, crystalline, silica, nitrogen oxides, and other products of combustion.

Effects of consultation
Since we did not receive any comment from the public during the EBR commenting period, there is no impact of public comment on the approval decision.
Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
