This decision is to renew Permit to Take Water No.3585-85KGHG for Rubicon Minerals Corporation for industrial and drinking water supply purposes. Water will be taken from the East Bay of Red Lake, located in the Township of Bateman, Red Lake, Ontario.The permit was issued on June 24,2020 under permit No. 2332-BQQQ69.

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on May 01, 2020, while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1726 for public comment from May 01, 2020 - May 31, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Effects of consultation

One comment was received opposing the proposal and suggesting that the decision should be made until after the pandemic-related restrictions are lifted and Ontario Regulation 115/20 expires.

This comment was considered during the evaluation of the proposal.

Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
