On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on May 26, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1815 for public comment from May 26, 2020 to July 10, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice

Instrument decision

Certificate of Property Use (CPU) No. 5600-BMBJWE was issued to 1260868 Ontario Limited on July 24, 2020 or the intended continued Commercial Use of the property.

The CPU requires the instrument holder to ensure that a number of risk management measures (RMMs) are undertaken on the property as a result of the risk assessment (RA) for its intended future use. Briefly, the key RMMs for the property include, but are not limited to, the following:

  • maintaining the existing building’s configuration as specified in Section 4.2 (a) of the CPU
  • inspecting and maintaining the existing building’s heating, ventilation and air conditioning (HVAC) settings as specified in Section 4.2 (b) of the CPU
  • inspecting and maintaining the existing building’s floor slab as specified in Section 4.2 (c) of the CPU
  • prohibiting the construction of any new building(s) on the property unless a soil vapour assessment has been completed and the new building(s) is constructed as specified in Section 4.2 (d)(i) and 4.2 (d)(ii) of the CPU
  • implementing a confirmatory indoor air monitoring program within the existing building as specified in Section 4.2 (o) of the CPU
  • implementing a soil and groundwater management plan during any intrusive activities undertaken on the property potentially in contact with COCs in soil and groundwater that have been identified in the RA at concentrations that exceed the applicable site condition standards as per Section 4.2 (q) of the CPU
  • implementing a health and safety plan during any intrusive activities undertaken on the property potentially in contact with COCs in soil and groundwater that have been identified in the RA at concentrations that exceed the applicable site condition standards as specified in Section 4.2 (r) of the CPU
  • implementing a groundwater monitoring program as specified in Section 4.2 (s) of the CPU
  • prohibiting the use of groundwater in on or under the property as per Section 4.3 of the CPU
  • registering a certificate on the property title in accordance with Section 197 of the Environmental Protection Act and that before dealing with the property in any way, a copy of the CPU is to be given to any person who will acquire an interest in the property as per Section 4.6, 4.7 and 4.8 of this CPU

Effects of consultation

No comments were received as a result of the consultation process and no changes were made by the director prior to finalizing the CPU.

Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
