A decision was made on November 26, 2021 to approve, with 13 modifications, Haldimand County Official Plan Amendments 57, 58, 59, 60, 61, 62, and 63 (OPAs 57-63), as adopted by By-law No. 1234-HC/21. OPAs 57-63 are part of a five (5) year review of the Haldimand County Official Plan being undertaken to conform with A Place to Grow: Growth Plan for the Greater Golden Horseshoe, 2019. The adopted OPAs 57-63 represent the first phase of the County’s official plan update, setting out a long-term growth management strategy for the municipality’s six urban areas. OPAs 57-63 implement a growth strategy for the urban communities in Haldimand County by amending urban area boundaries, amending and adding land use designations, and by amending and adding site-specific policies. The purpose is also to establish a water supply protection corridor from the Nanticoke Water Treatment Plant to serve the communities of Caledonia and Cayuga.

OPAs 57-63 were reviewed for consistency with the Provincial Policy Statement, 2020 and conformity with A Place to Grow: Growth Plan for the Greater Golden Horseshoe, 2019, including the policies related to water quality and protecting the environment.

Thirteen (13) modifications have been made by the Minister to ensure that the Official Plan Amendments are consistent with the policies of the Provincial Policy Statement, 2020, conform with A Place to Grow: Growth Plan for the Greater Golden Horseshoe, 2019, and comply with applicable legislation

Other Information

Pursuant to subsections 17 (36.5) and (38.1) of the Planning Act, this decision is final and not subject to appeal. Accordingly, the Official Plan as approved with modifications by the Minister came into effect on November 26, 2021.

As a result of public consultation on adopted OPAs 57-63, the Ministry received a total of one (1) comment through the Environmental Registry of Ontario, and an additional two (2) comments through email to Ministry staff.

The first submission received was in regard to a block of land in the south of Hagersville that was not included in the settlement area boundary as identified in OPAs 57-63. The submission included a request to include these lands in the settlement area boundary to facilitate residential development. Provincial policy and guidance for settlement area boundary expansions includes flexibility for municipalities to consider local conditions and priorities. The municipal comprehensive review process and land needs assessment undertaken by Haldimand County in accordance with the requirements of A Place to Grow: Growth Plan for the Greater Golden Horseshoe were reviewed and it was determined that no modification to the settlement area boundary was required.

The second submission received was in regard to a development setback around an active quarry in Hagersville. The submission includes a request to increase the development setback to 500 meters from the 300 meters proposed in the OPAs 57-63. As provincial guidance for development setbacks around quarries require a minimum distance separation of 300 meters, no modification to the policy was required.

The third submission received requested that the intensification targets in A Place to Grow: Growth Plan for the Greater Golden Horseshoe be met, as opposed to a lower alterative intensification target. A Place to Grow: Growth Plan for the Greater Golden Horseshoe allows municipalities to request an alternate intensification target, which must be approved by the Minister of Municipal Affairs and Housing. Based on the information provided by Haldimand County from the Haldimand County Official Plan Update: Phase 1 Report Growth Strategy Report, Haldimand County is anticipating multiple constraints to achieving the intensification target in A Place to Grow: Growth Plan for the Greater Golden Horseshoe. As a result, the Minister approved Haldimand County’s alternative intensification target request.

Appeals are not allowed

Pursuant to subsection 17 (36.5) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding Notice of Decision County of Haldimand Official Plan Amendments 57-63_0.pdfs 57-63 adopted in accordance with section 17 and 26 is final and not subject to appeal.

On June 28, 2021, Haldimand County Council passed By-law No. 1234-HC/21, to adopt its official plan update, comprised of Official Plan Amendments 57, 58, 59, 60, 61, 62, and 63 (OPAs 57-63), which are now before the Minister of Municipal Affairs and Housing for a decision under the Planning Act. If approved by the Minister, OPAs 57-63 would amend the County’s existing official plan.

OPAs 57-63 are part of a five (5) year review of the Haldimand County Official Plan being undertaken to conform with A Place to Grow: Growth Plan for the Greater Golden Horseshoe, 2019. The adopted OPAs 57-63 represent the first phase of the County’s official plan update, setting out a long-term growth management strategy for the municipality’s six urban areas. OPAs 57-63 implement a growth strategy for the urban communities in Haldimand County by amending urban area boundaries, amending and adding land use designations, and by amending and adding site-specific policies. OPAs 57-63 determine where and how the County will grow, based on population and employment forecasts and a land needs assessment – aligning urban boundaries with market demand. Based on the forecasts prepared by the County’s consultant, the County is expected to grow to a population of 77,000 residents by 2051.  This forecast is higher than the forecast set out in A Place to Grow, which requires Haldimand County to plan for a minimum population of 75,000 residents by 2051. A Place to Grow allows municipalities to establish higher growth forecasts through municipal comprehensive reviews.

OPAs 57-63 contemplate a decrease in the County’s intensification target required in A Place to Grow from 32% to 20%. The intensification target is a measure of how much new residential development takes place in the County’s delineated built-up area (its existing developed urban area). Haldimand County identified that there are limited opportunities for intensification and that it will have difficulty achieving the current intensification target.

The Minister of Municipal Affairs and Housing is, under the Places to Grow Act, responsible for making a decision on Haldimand County’s Feb. 18, 2021 request for an alternative intensification target.

The Minister of Municipal Affairs and Housing is, under the Planning Act, the approval authority for OPAs 57-63. The decision of the Minister must be consistent with the Provincial Policy Statement, 2020, and must conform with A Place to Grow. The decision of the Minister on these official plan amendments is final and is not subject to appeal.
