On March 30, 2026, we issued an amendment to the Environmental Compliance Approval to Jones Group Ltd. for the processing of soil slurries at the facility located at 7809 Howard Avenue in McGregor, Ontario.
The following amendments to the site have been approved:
- additional waste type included to allow for the receipt and processing of liquid soil from hydro-excavating activities
- dewatering of liquid soil by gravity drainage into a dewatering pit constructed on a built-up clay base
- management and temporary storage of the dewatered liquid soil
- blending, bulking and mixing of the dewatered liquid soil
- sampling and testing of dewatered liquid soil quality
- storage of up to 40,000 tonnes of excess soil including liquid soil and dewatered liquid soil at any one time; and
- transfer from the site to approved destinations

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

The Jones Group Ltd. owns the combined contractor’s yard and waste management facility located at 7809 Howard Avenue in McGregor (Amherstburg), Ontario.
The facility operates with Environmental Compliance Approval No. 5291-9X3NDV for the receipt and processing of solid non-hazardous construction and demolition waste and other scrap metals up to 327 tonnes per day on a 7.5 hectare property.
Total waste and processed materials, including clean wood for grinding and stockpiling, scrap metal sorting and stockpiling, and concrete and asphalt receiving, sorting, crushing, screening and stockpiling, does not exceed 35,000 tonnes at any time.
The Jones Group Ltd. has applied for a minor technical amendment for a waste processing site (other than hazardous/liquid industrial) to receive and process excess soil and soil slurries from local sources and ongoing construction, demolition, infrastructure, and repair projects.
A maximum of 300 tonnes per day of incoming excess soil and soil slurries will be processed by gravity drainage, turning, soil mixing, and blending from an inclined gravel pad underlain by compacted native clayey soil with a maximum of 40,000 tonnes stockpiled at any time.
Incoming and processed excess soil bulk quality testing is completed in consideration of beneficial reuse at destination properties. Shallow groundwater quality is monitored on a quarterly basis from locations in proximity to facility operations, and surface water quality monitoring is completed at prescribed locations and frequency in compliance with the industrial sewage works Environmental Compliance Approval requirements, as input toward whether facility operations impact the surrounding natural environment.
The Facility serves the Province of Ontario and operates Monday to Friday from 7 a.m. to 6 p.m.
