On November 30, 2022, we approved a new Environmental Compliance Approval (ECA) for Lamoureux Pumping Inc. for a waste disposal site (transfer).

The ECA approves a new waste transfer site for the receipt and transfer of non-hazardous waste limited to liquid organic waste generated from industrial, commercial and institutional sources within Ontario, including:

  • slaughterhouse blood and water
  • organic waste matter from grease traps and interceptors used for the treatment of wastewater from food or feed processing or preparation facilities
  • whey and milk washwater from cleaning the processing equipment and the surrounding area in a facility for processing dairy products

The site will receive and temporarily store the liquid waste in two 200 cubic metre in-ground storage tanks constructed near the northeastern corner of the site. The trucks will load and unload the waste via camlock connections to minimize the chance of spills and odours, and the loading/unloading will take place on an impermeable pad that is equipped to capture and contain the largest potential spill. The in-ground storage tanks are also equipped with a leak-detection system so that any leaks are quickly identified.

The site is approved to receive up to 180 cubic metres of liquid waste per day and 10,400 cubic metres of liquid waste per year, with a maximum storage limit of 400 cubic metres of liquid waste.

The site is approved to operate between 5:00 a.m. to 9:00 p.m. Monday through Friday and 5:00 am to 5:00 pm on Saturday, unless restricted by municipal by-laws.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for a new Environmental Compliance Approval (waste disposal site) for a non-hazardous liquid waste transfer facility, located at 2251 County Road 8 in The Nation Municipality, Ontario.

The proposed waste storage and transfer facility will be used for organic waste, including:

  • slaughterhouse blood and water
  • grease interceptors
  • whey
  • milk wash water

It is proposed that the organic waste material be stored in two 200 cubic metre in-ground storage tanks constructed near the northeastern corner of the site. The tanks will be equipped with mixers to prevent the waste from solidifying or freezing. No heating components are anticipated to be added to the units at this time.

It is anticipated that approximately 200 cubic metres of non-hazardous liquid waste will be accepted at the site weekly, and 10,400 cubic metres annually. The organic wastes will be collected from restaurants, slaughterhouses, and cheese factories in eastern Ontario and southern Quebec. The material will be periodically disposed of at a licensed facility.

The site generally operates from:

  • 7:00 a.m. through 5:00 p.m. Monday through Friday
  • 7:00 a.m. to 1:00 p.m. on Saturday
