On April 12, 2023 we approved a new Environmental Compliance Approval (ECA) for 117 Disco Road Inc. for a waste disposal site (transfer).

The ECA approves a new waste transfer site for the receipt and transfer of non-hazardous waste limited to excess soil and soil containing construction and demolition debris (e.g. asphalt, inert fill, etc.) generated within Ontario.

All incoming waste will be unloaded, stored, handled and loaded indoors within the proposed building. Waste management activities are limited to temporary storage and mixing of soils in the indoor soil storage bunker with compartments for soil segregation.

All soil will be sent off-site for final disposal or further processing at an approved waste disposal site. No soil will be received at the site for direct reuse at a reuse site.

The site is approved to receive a maximum of 2,000 tonnes of solid non-hazardous waste per day, with a maximum storage limit of 2,000 tonnes of non-hazardous waste.

The site is approved to operate 24 hours per day, 7 days a week, unless restricted by municipal by-laws.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

    • a statement about whether you are a resident in Ontario

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is for a new Environmental Compliance Approval (waste disposal site - transfer facility) for 117 Disco Road Inc. The non-hazardous waste transfer facility is located at 117 Disco Road in Toronto, Ontario, on a site that is approximately two acres in area.

Approval is sought for the receiving and transfer of solid non-hazardous contaminated soil, including impacted asphalt, inert fill and soil-like material only. All waste received will be non-putrescible.

The source of the soil material will be from excavations related to the clean-up of residential, commercial, and municipal properties, as well as utility rights-of-way and municipal roads from the Greater Toronto Area.

The soils transported to the site will be placed on the tip floor inside the building and stored for no more than 72 hours. Contaminated soil will be loaded onto trucks and transported to licensed soil treatment facilities or landfills.

The maximum quantity of soil to be received daily will be 2,000 tonnes of dry soil. All transfer and storage will occur indoors. The maximum on-site storage capacity will be 2,800 tonnes of soil.

The service area of the operation will be from soil locations within the Province of Ontario. The hours of operation will be 24 hours per day, seven days a week, and 365 days a year.
