The application for consent 59-C-223079 was draft approved on October 19, 2022 subject to conditions.
The application was reviewed for consistency with the environmental policies of the Provincial Policy Statement (e.g. natural heritage, water quality protection). No public comments were received, or concerns identified.
Nydia Lake is designated by policy as an inland lake trout lake but given the small scale of this proposal to alter lot lines between existing properties, and since no new lot or development is being created, there will be no negative impacts to greenspace, natural heritage and water quality and quantity, nor public health and safety.
Conditions include an inspection by the Northwestern Health Unit of Lots 6 and 7 for suitability of sewage systems; and an acknowledgement of awareness by the transferors and transferees that the Province of Ontario does not guarantee road access to the property via Crown Land; that future applications for dispositions may not be approved by the Ministry of Natural Resources and Forestry as Nydia Lake is designated as an inland lake trout lake; and that work permits are required from Ministry of Natural Resources and Forestry for any future development along shorelines or Crown Land.
The decision to approve the consent is consistent with the Provincial Policy Statement once conditions are met. This decision will not have a significant impact on the environment.
The applicants have two years to satisfy conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before November 7, 2022.

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

The purpose of this application for consent is to transfer Part 7 of Plan 48R-3360, which is a surveyed shoreline road allowance to the abutting lot described as Lot 7 of SM-229. Part 7 has 47.43 metres of shoreline frontage and an area of 0.087 hectares. Retained is 0.54 hectares of land which contains cottage, guest cabin, garage, and sauna buildings.
The subject lands are located approximately 35 kilometres east of the municipal boundary of the Town of Atikokan. Access to the subject land is by Camp 111 Road and Nydia Lake Road, public use roads through Crown Land.
