The approval include the following:

  • the additional incoming waste will be processed inside the building and the processed waste will be stored inside or outside under cover before transfer to reuse or disposal. As a result, no additional impact to the environment is anticipated.
  • to accommodate expansion of site operations, the service area has changed to Canada and USA.
  • the daily transfer of residual waste from the facility shall not increase 1000 tonnes per day, based on annual average.
  • the acceptance of additional waste is subject to the submission and approval of Financial Assurance by the Director and a prior notification to the District Manager.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

  • appellate body

This proposal is to amend the existing Environmental Compliance Approval (ECA) No. 1262-875PPC for the Arrow Road Materials Recovery Facility located in Toronto, Ontario. The facility, which receives recyclable material for processing and marketing, is located on a 11.2 hectare property and operates 24 hours per day, 7 days per week.

The facility has evolved into a regional facility. GFL proposes to amend the service area for the Arrow Road Facility in order to provide recycling services beyond Ontario for:

  • other provinces
  • various states

The existing ECA Condition 14 regarding approved waste quantities, and Condition 15 with respect to waste storage, will be amended to increase the limits on the quantity of waste received and stored at the site by increasing the permitted:

  • maximum annual tonnage limit of waste received from 500,000 tonnes to 620,500 tonnes
  • daily average of waste received from 1,370 tonnes to 1,700 tonnes
  • daily maximum of waste received from 1,650 tonnes to 2,500 tonnes
  • daily quantity of waste storage (including unprocessed waste, in-process waste, and residual waste) on-site from 2,500 tonnes to 3,500 tonnes
  • daily quantity of processed recyclable material storage from 2,000 tonnes to 6,500 tonnes

There is a need to increase operations at the facility from one (1) to three (3), eight (8) hour shifts, five days a week for Building 122 which is similar to the current operations in Building 124.

Condition 21 of the ECA will also be amended to allow daily site inspections to be documented electronically.
