The Supreme Court of Canada in ruling on Spraytech v Hudson 2001 found in favour of the principle of subsidiarity. Subsidiarity proposes that law making and implementation are often best achieved at a level of government that is not only effective but also closest to the citizens affected and thus most responsive to their needs, distinctiveness and diversity.
The direction and management of Ontario's Conservation Authorities is a case in point. They have been operating effectively for over six decades. While there is always room for improvement, this can clearly be done through expanded constructive cooperation rather than destructive consolidation. Equally clearly, municipalities should not be asked to provide 90% of government funding for 100% provincially directed and managed organizations.
This proposal is poorly considered, poorly consulted, poorly constructed and poorly presented and needs to be withdrawn.
