Hello

I represent Kieswetter Development Corp. ("KDC"), who are the owner's of the lands at 41 Ira Needles Boulevard in the City of Waterloo. Schedule 'E' of the new Official Plan illustrates a future road connection extending to Erb Street through the subject lands.

A Draft Plan of Subdivision application and rezoning are currently being processed by the City of Waterloo for the abutting lands at 651-663 Erb Street West. Those lands currently contain a stormwater management facility which acts as an outlet for the surrounding catchment area - including the lands of 41 Ira Needles Boulevard. This shared facility was essential in planning the future development within the area, yet the current development proposal appears to disregard this obligation.

The City has approved Schedule 'E' showing this future roadway connection proceeding through this area without addressing stormwater management related issues for upstream landowners.

KDC strongly objects to the road alignment proposed through this area. The proposed configuration primarily benefits the abutting property owner by freeing up development land and reducing their development costs while imposing unfair burdens on KDC. Specifically KDC would be responsible for connecting their proposed roadway to the Thorndale Drive / The Boardwalk termination point. The "curve" of the the future proposed roadway (to connect to the Boardwalk) is located on the KDC lands. In short, KDC would be unfairly burdened with significant costs for the roadway construction as well as the loss of opportunity as a result of the land conveyance required to facilitate the road construction.

Equitable road and cost sharing agreements are essential to prevent disproportionate impacts on area landowners. It is essential that the City have regard for these arrangements before any Decision can be rendered on Schedule 'E' identifying this road connection.

The City should take proactive steps to address stormwater management and the road alignment issue prior to indicating a formal location on an Official Plan schedule. The identification of the road alignment on Schedule 'E' is detrimental to KDC as it appears to prejudge the road location and as a result the development layout of the KDC lands.

We request the Ministry remove the identification of this future road connection on Schedule 'E' as part of the formal approval process. Discussions with the City and surrounding landowners are ongoing and need to be resolved prior to the road alignment being formalized.
