In regards to the Excess Soil Regulations, there is a lot of uncertainty as to what is required by those looking to dump excess soil/inert material and also sites receiving them. As a licensed pit, we have always received inert material for rehabilitation. With these new rules, we were under the impression that small trailer loads of inert material or jobs less than 250 cu.mts. could come to us but after accumulating 1000 cu.mt, we would have to test the material under REG 406. This test costs upwards of $1500 to complete, and if contamination was found, we would need to dispose of the entire pile appropriately. With potential high disposal costs, we would then need to limit or stop these small loads of inert material coming to us, or charge high prices to account for the costly testing or the even higher cost of contaminant disposal. These regulations have caused us to panic, along with the landscaper/contractor who now has no place to bring their inert material. As a result, construction and landscaping jobs will either slow or come to a complete halt. There needs to be further explanation of what is required of the sites receiving excess soil/inert material and who the regulation is actually targeting. Too much uncertainty leads to one's own interpretation thus creating more problems with excess soil.
