On November 24, 2025, we issued an amendment to the Environmental Compliance Approval to Tomlinson Environmental Services Ltd. for a composting facility located at 2069 Joyceville Road, Kingston, Ontario.
The following amendments to the site have been approved:
- increased maximum and average waste receipt to 1000 tonnes/day and 200 tonnes/day, respectively
- increased indoor storage duration of waste to 72 hours or 150 tonnes, whichever comes first
- revised residual waste storage to 150 tonnes
- revised duration of leaf and yard waste storage to 90 days
- replaced use of GORE covers with wood chips
- adjustment of operating hours on Saturday to 8:00 a.m. to 3:00 p.m
- service area expanded to include the Province of Ontario
- approved the indoor use of a depackaging unit

The information below summarizes the public's comments and how we considered and addressed them as part of our decision:
- Concerns about site expansion to account for increase in daily waste received and expansion of service area.
- response: the site size is not expanding. The increase in waste receipt rates does not result in an increased storage capacity. Processing and shipment speed will increase to address the increase in waste receipt rates
- Concerns with inorganic or hazardous waste materials being processed.
- response: tomlinson is required to complete inspections of each incoming waste load prior to processing through the compost facility. Unacceptable waste will be rejected. In addition, following compost processing, the finished product is subject to strict sampling and testing requirements to ensure the marketed compost meets Ontario’s Compost Quality Standards

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for an amendment to the existing Environmental Compliance Approval (waste disposal site) No. 4875-7F4N5K for Tomlinson Environmental Services Ltd., operating a waste processing and transfer site located at 2069 Joyceville Road, Kingston, Ontario.
The Environmental Compliance Approval was issued for the use and operation of a processing and transfer site, with a total site area of 5.73 hectares, to be used for transfer and processing of source separated organic waste, leaf and yard waste, food waste, inert powders, waste wood, clean wood, sewage biosolids, pulp and paper biosolids, manure, unpainted clean gypsum, and liquid industrial organics.
The total amount of waste and processed materials stored at the site is not changing. The waste disposal site is to serve the Province of Ontario. The current hours of operation are from:
- 7:00 a.m. to 7:00 p.m. Monday to Friday
- 8:00 a.m. to 1:00 p.m. Saturday
The proposal includes changes to the following:
- Total average daily amount of waste received from 100 tonnes to 200 tonnes per day.
- Total maximum daily amount of waste received from 100 tonnes to 1,000 tonnes per day.
- Modification to waste storage duration requirement for potentially odorous materials received and pre treated/ blended indoors within one day, or up to a maximum of 48 hours to within 2 business days, unless there is not adequate volume to start a windrow then the material will be stored indoors and put into the windrow when the volume is 150 tonnes.
- Revise residual waste transfer from site from weekly basis to when containers are appropriately filled.
- Removal of the GORE covering system and instead, including addition of wood mulch.
- Change the waste acceptance area from Southern Ontario to Province of Ontario.
- Change the operating hours on Saturdays from 8:00 a.m. to 1:00 p.m. to 8:00 a.m. to 3:00 p.m.
