Approval is granted for the following:

  1. The receipt of non-hazardous liquid industrial waste for Ontario Waste Classes No.: 251, 252, 253, 254 and 212 (glycols) and contaminated wastewater to be generated from on-site washing of hydrovac trucks and tankers.
  2. The waste will be stored outdoor in 4 aboveground double walled stainless steel tank to be placed on a concrete pad with containment curbs.
  3. The liquid industrial waste including contaminated wastewater will be stored on-site in the above-ground storage tanks for up to a maximum of 90 days before transfer to recycling/disposal to lincensed facilities.
  4. Waste will be collected from industrial and commercial clients within the Province of Ontario, and
  5. The facility may receive, ship, and process waste 24 hours per day, seven days per week.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

  • appellate body

This proposal is for a new Environmental Compliance Approval for GFL Environmental Services Inc. for the use and operation of a waste transfer/processing facility with a total site area of 1.64 acres, located at 2329 Royal Windsor Drive in Oakville, Ontario.

The function of the Waste Disposal Site is to:

  1. receive, consolidate and transfer liquid industrial wastes from fleet maintenance and washing activities; and
  2. receive, temporarily store and transfer non-hazardous wastes (not more than 90 days) to other Ministry of the Environment, Conservation and Parks (MECP) approved recycling/disposal facilities.

The Site footprint will include a 100 square metres concrete pad with containment curbs to provide stability for up to four double wall above-ground storage tanks with a maximum capacity of 60,000 litres each. Barricades will be placed around the pad to provide collision protection for tanks, valves and pumps, and a 70 squared metres concrete pad with containment curbs for the unloading / washing activities.

The activities that will be conducted at the Site are summarized below:

  • the receipt of bulk waste such as oils/waters (waste classes 251, 252, 253, and 254), glycols (waste class 212) and contaminated waters for consolidation in outdoor storage tanks (up to a maximum of 90 days) before transfer to recycling/disposal facilities. The transfer of bulk containers to outdoor storage tanks, or the loading of tankers from the outdoor storage tanks will be conducted via electric driven transfer pumps.
  • unloading and washing hydrovacs, tankers and vacuum trucks on the concrete pad with containment curbs, including a sump to collect the wastewater. Excess water generated will be transferred to the vertical tanks for temporary storage and further disposal.

Waste will be collected from industrial and commercial clients within the Province of Ontario. The facility may receive, ship, and process waste 24 hours per day, seven days per week.
