An Environmental Compliance Approval was granted to Boem Berry Farms Inc. for the stormwater management works for the collection, transmission, treatment, and disposal of stormwater run-off from the greenhouse site with a total drainage area of 47.86 hectares including phases 6 and 7 development, located at 496 Road 2 East, in the Town of Kingsville, County of Essex, Ontario.

The approved works include greenhouse roof water drainage pipe systems, two irrigation water storage reservoirs, swales and on-site storm sewers, two oil/grit separators serving parking lot and driveway areas, and one stormwater management pond having an active storage volume of 44,064 cubic metres for the 100 year storm event, complete with a pump station and outlets structures and discharging final effluent with controlled maximum release rate, 24 litres per second for the 2-year storm or 65 litres per second for the 100-year storm event, into the North Jasperson Drain.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

  • appellate body

This proposal is for an Environmental Compliance Approval application serving Boem Berry Farms Inc., for the stormwater management works serving the Boem Berry Farms Phase 6 and 7 Greenhouse development site for collection, transmission, treatment, and disposal of stormwater run-off from the lands located at 526 Road 2 East, in the Town of Kingsville, County of Essex, Ontario.

The facilities consist of the following:

  1. Roof water drainage pipe systems, discharging roof top runoff to the irrigation pond;
  2. Swales and on-site storm sewers, discharging surface runoff to the stormwater detention pond;
  3. One stormwater management detention/wet pond having an active storage volume of 44,064 cubic metres with a maximum active water depth of 4.894 metres for the 1:100-year storm event, discharging a maximum release rate of 65 litres per second into the Private Repko Drain;
  4. One irrigation reservoir used to collect and store water. Water collected from roof runoff is to be used for irrigation purposes inside the greenhouse. Should the reservoirs be full, and a storm event happens, the reservoir will spill to the SWM pond;
  5. One detention pond pump station discharging into the outlet structure (CBMH1) through two 100 millmetres diameter force main pipes and 375 millmetres diameter gravity pipe from pond which will act as a bypass when the pond is filled and there is a failure in pump;
  6. One outlet structure (CBMH1) containing a 375 millmetres diameter outlet pipe with a lockable valve box and containment valve, and a flap gate on the 375 millmetres diameter inlet pipe from the pond.
  7. One Oil Grit Separator (OGS) ADS model FD-4HC or approved equal serving the gravel parking and driveway areas;
  8. One emergency overflow spillways from the detention pond directed to DICB1 for discharge to the North Jasperson Drain
