An approval was granted to Under Sun Acres Inc. to amend ECA 8046-BRPJE9 for the proposed expansion and modifications of sewage works to accommodate the additional employment population from new Phase 3 expansion of vegetable greenhouse and bunkhouse, located at 620 Mersea Road 10, in the Municipality of Leamington, Ontario.
The approved modifications are to expand an existing Moving Bed Biofilter Reactor (MBBR) sanitary sewage treatment works from 25,000 litres per day to a rated capacity of 40,000 litres per day, including a new 17,700 litres grease interceptor and 11,365 litres grinder pump station for phase 3 development, a new 50,000 litres sludge storage tank added to the exiting 50,000 litres sludge storage/primary clarification tank, expansion of existing two-stage to three-stage MBBR treatment unit to an expanded total volume capacity of 28,200 litres, an expanded final clarifier and modifications/addition of chemical dosing systems, together with existing phases one and two pre-treatment units, flow equalization tank, filtration and ultraviolet disinfection systems, designed to achieve tertiary effluent quality required for dry-ditch discharge to the West Branch of Reid Drain at Highway 77, which is a municipal drain tributary to the Ruscom River.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

This proposal from Under Sun Acres Inc. is for an amendment to the Environmental Compliance Approval No. 8046-BRPJE9 for expansion of a moving bed biofilm reactor (MBBR) wastewater treatment facility, to service the additional employment population of an expanding vegetable greenhouse, with warehouse, office and other accessory facilities located at 620 Mersea Road 10, in the Municipality of Leamington, Ontario.
The proposal is to expand an existing MBBR wastewater treatment process from 25 cubic metres per day to a rated capacity of 40 cubic metres per day. The existing and proposed works include pre-treatment facilities comprised of fats-oil-grease interceptors, flow equalization and primary sedimentation, together with expansion of an existing moving bed biofilm reactor and additional wastewater treatment process units, including alkalinity supplementation, pH adjustment, phosphorus removal through chemical precipitation, tertiary filtration, ultraviolet disinfection and continued gravity effluent discharge to surface water.
The proposed wastewater treatment facility is designed to achieve tertiary effluent quality required for dry-ditch discharge to the West Branch of Reid Drain at Highway 77, which is a municipal drain tributary to the Ruscom River. The Ministry of the Environment, Conservation and Parks (MECP) will require continued monitoring of the treated wastewater effluent discharge leaving the site.
