Description of Instrument
At the request of the registrant, Bayer CropScience Inc., the Ministry of the Environment, Conservation and Parks is proposing that the following three commercial pesticide products be reclassified into Class 3 pesticides under Ontario Regulation 63/09 made under the Pesticides Act.
- Method 50SG (Reg. No. 30917),
- Navius Herbicide (Reg. No. 30922), and
- Navius VM Herbicide (Reg. No. 31382)
These three products are currently classified as Class 2.
The Ontario Pesticides Advisory Committee (OPAC) has recommended that these three commercial end use products be reclassified and placed in Class 3 based on the soil persistence for the active ingredient aminocyclopyrachlor greater than a month and less than six months.
Health Canada's Pest Management Regulatory Agency (PMRA) assesses pesticides for their risks to human health and the environment, and examines the efficacy and value of pest control products in registering products under the Pest Control Products Act for sale and use across Canada.
In Ontario, the Pesticides Act and Ontario Regulation 63/09 stipulate that all federally registered pesticides must be classified in Ontario before it becomes legal for sale and use.

- Use Area: Non-Crop Areas such as Rights of Way, roadsides, industrial sites, fence lines and other non-crop areas
- Pest: Control/suppress of Brush, Woody plants and Broadleaf Weeds
- Provisional Class: 3
Class 2 pesticides are federally designated as restricted or commercial products, and are very hazardous with soil persistence greater than or equal to six months. Class 2 pesticides are subject to provincial use permits if the PMRA has approved the aerial application on product labels.
Class 3 are federally designated as restricted or commercial products, and are moderately hazardous with soil persistence greater than a month or less than six months. Class 3 pesticides are to be used by licensed exterminators and certified growers.
