Approval granted for the establishment of industrial stormwater management Works to serve Alpine Auto Collision and Body Repair shop, located at 39 Commerce Road, for the collection, transmission, treatment and disposal of stormwater run-off from a total catchment area of 0.42 hectares, to provide Enhanced Level water quality protection and erosion control, and to attenuate post-development peak flows to pre-development peak flows for all storm events up to and including the 100-year storm event, discharging to existing rear yard easement / drainage ditch, consisting of the following:

Proposed works:

  • enhanced grassed swale, located along the site perimeter having a total length of 76 metres, a bottom width of 200 millimetres, side slopes of 3:1 a maximum depth of 250 millimetres, a maximum flow depth of 100 millimetres, allowing a maximum discharge of 11 litres per second under the 100-year storm event into the dry pond described later on;
  • oil/grit separator, (StormSettler Model StormTrap ETV sSet4) located downstream of the parking lots and asphalted lay by movement areas, having a sediment storage capacity of 415 litres, an oil storage capacity of 243 litres, a total storage volume of approximately 658 litres, and a maximum treatment rate of 28.4 litres per second, discharging via a 250 millimetres diameter outlet pipe into a dry pond described below:
  • dry pond, located at the north-east corner of the site on an area of 271 square metres, having a maximum available storage volume of 53 cubic metres and a maximum depth of 700 millimetres, complete with one inlet structure, consisting of a 250 millimetres diameter storm sewer, one emergency overflow weir and riprap-lined spillway, and one  outlet structure, consisting of 250 millimetres diameter storm outlet pipe equipped with a 125 millimetres diameter Hydrovex control orifice, allowing a maximum discharge of 32.8 litres per second under the 100-year storm event into the existing rear yard easement/drainage ditch; to finally flow into a municipal drain of the industrial subdivision

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for a new Environmental Compliance Approval (sewage) to install stormwater management works facilities serving the Alpine Auto Collision body shop, for the collection, transmission, treatment and disposal of stormwater run-off from the lands located at located at 39 Commerce Road, in the Town of Orangeville, Ontario.

The proposed stormwater system includes storm servicing for the parking lot and roof drainage of an automotive body and paint shop facility; and a dry pond with an outlet control structure, quantity and quality control; discharging via drainage swales along the property rear, within the Credit Valley Watershed.
