Effets de la consultation

Comments relevant to the water-taking proposal were considered as part of the review of the application. The main concerns raised were regarding the following:

  • potential impacts of the groundwater taking on nearby private wells and natural features
  • request for a contingency plan to address water-taking during low-water conditions
  • suggestion to review and potentially revise the permitted water-taking volume based on actual use

In consideration of these comments, the technical information associated with this taking was reviewed. The potential for impacts to nearby private wells and natural features is low as there rea no significant groundwater receptors or natural surface water features within the taking zone of influence and there have been no reports of interferences with nearby private wells during the term of the previous Permit.

With respect to low-water response conditions, the Ontario Low Water Response (OLWR) Program applies primarily to surface-water users and employs a collaborative approach to manage surface-water withdrawals during low water periods. As the purpose of the takings are for groundwater remediation and takings are not likely to impact surface water, a contingency plan for low-water conditions is not required.

The reported water-use data were also reviewed in consideration of the suggestion to revise the permitted volume. It was concluded that the currently authorized volume remains appropriate based on the remedial purpose of the taking and the variability in site groundwater conditions. Recorded withdrawals remain well below the permitted limits, and no exceedances were identified.

Ministry staff have therefore determined that the conditions of the permit are sufficient to ensure that any potential effects can be identified and addressed through adaptive management, if necessary.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

There are three categories of a Permit to Take Water:

  • Category one: water takings are anticipated to have a lower risk of causing an unacceptable environmental impact/interference
  • Category two: water takings are anticipated to having a higher potential of causing unacceptable environmental impact or interference
  • Category three: water takings are anticipated to have the highest potential of causing unacceptable environmental impactor interference

The proposed water taking qualifies as a Category three Permit.
