The Ministry of Municipal Affairs and Housing received a request to amend Minister’s Zoning Order, Ontario Regulation 91/23 that applies to lands in the City of Mississsauga. The Ministry is seeking input on whether this request should be considered and any additional information that may help inform the Minister’s decision-making.

A Minister’s Zoning Order (MZO), made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land, and prevails over the existing municipal zoning by-law to the extent there is any conflict.
The Minister is considering a request from Glen Schnarr and Associates, on behalf of the Lakeview Community Partners Limited, to amend the MZO filed as Ontario Regulation 91/23 pursuant to subsection 47(8) of the Planning Act. The area covered by Ontario Regulation 91/23 is approximately 71.6 hectares in size and the subject lands are located between Lakeshore Road East and Lake Ontario in the City of Mississauga (former Lakeview Generating Station site). Ontario Regulation 91/23 facilitates the development of up to 16,000 residential dwelling units, other mixed-uses (e.g. employment and commercial uses), and parks on the subject lands.
Since O. Reg. 91/23 was filed, the landowner and the City of Mississauga have been working closely with the Office of the Provincial Land and Development Facilitator to resolve issues and advance development of the Lakeview site, in accordance with Ontario Regulation 91/23.
On April 8, 2024, the Minister issued an order under subsection 49.2 of the Planning Act, requiring the landowners and the City of Mississauga to enter into agreements to address various matters related to the development of the Lakeview site (e.g. registering plans of subdivision, community benefits, affordable housing, etc.).
As a result of this coordinated process, the landowners, in consultation with City staff, are proposing a number of minor and/or technical changes to Ontario Regulation 91/23 to help clarify interpretation, streamline development review, and facilitate the processing of applications by the City. The proposed amendment will also address minor mapping changes and reflect subsequent updates to the Planning Act with respect to parking in major transit station areas and additional residential units.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision.
