Conditional Filing Orders are not currently prescribed as an instrument under the Environmental Bill of Rights, 1993.
Détails
Alamos Gold Inc. (the “Proponent”) has submitted a request for a conditional filing order to the Ministry under Part VII of the Mining Act (the “Act”). A conditional filing order allows a proponent to submit a closure plan (CP) or closure plan amendment (CPA) that does not meet all statutory requirements at the time of submission.
The Minister may issue a conditional filing order for a CP or CPA if, before the proponent submits the CP or CPA, the proponent submits a request for the order in the prescribed form and manner, and the Minister determines that the order would be consistent with the purposes of the Act.
All conditional filing orders must include terms and conditions, including the mandatory condition that the proponent meet the outstanding requirements within a specified time and manner, and any other terms or conditions the Minister considers appropriate.
The Proponent has applied for a conditional filing order that would allow it to omit the following required items from its closure plan amendment submission:
- updated certification and plan for managing acid rock drainage and metal leaching for closure
- geochemical testing of drill core, pit wall rock, construction rock, and monitoring of runoff from overburden
- detailed design for tailings storage dams for closure
- a crown pillar stability study to confirm safe closure methods for underground openings, including the No. 2 ventilation raise
The delayed submission of the requirement(s) will not impair the proponent’s ability to determine adequate rehabilitation measures for all mine hazards associated with the project for the following reasons:
- most of the mine waste materials — ore, waste rock, and tailings — have already been properly tested and meet regulatory standards. Additional testing is underway to confirm acid rock drainage and metal leaching results, and the existing data represents drill core, pit walls, and construction rock. Water from stockpiles naturally drains into controlled areas like the open pit and stormwater ponds, where it is managed through pumping, treatment if needed, and discharge under approved environmental permits. Water quality is regularly monitored to ensure compliance
- stability analyses for the two tailings dams have already been completed and include the closure cover design described in the closure plan. These checks meet industry standards for stability during both active and long-term closure phases. The rehabilitation measures outlined in the closure plan are designed to keep the dams stable over time, and the full details will be included in the upcoming feasibility study
- the crown pillar stability study is still in progress, but financial assurance has been provided to complete the work and secure all crown pillars on site. This study will also confirm the best method for safely closing the No. 2 ventilation raise
This notice is provided to receive comments that can be considered in the decision-making process.
If issued, the conditional filing order does not relieve the proponent from compliance with any other requirements that are set out under the Mining Act, its regulations, or any other Act.
