The retained lands are accessed off of Highway 105; and the receiving lands are accessed by Highway 609.  The subject property is roughly 10 km north of the Municipality of Machin and just east of the community of Quibell.

Application for consent was originally approved on March 20, 2020 with standard conditions. Applicant had one (1) year to satisfy conditions otherwise approval will lapse.

On March 17, 2020, in response to the COVID-19 outbreak, the government of Ontario declared an emergency under the Emergency Management and Civil Protection Act. As a result, Ontario Regulation 149/20 was filed to apply special rules relating to Planning Act timelines. Due to these special rules, appeal timelines that would have ended between March 17, 2020 and April 15, 2020 are deemed to have not ended.

Given the recent passing of Ontario Regulation 149/20, this Notice is being reissued on April 29, 2020 with a firm last date of appeal of May 19, 2020. The Decision issued under ERO number 019-1275 on March 20, 2020 is still valid.

For further information on Ontario Regulation 149/20, you can also refer to the Bulletin issued under ERO number 019-1653.

The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Local Planning Appeal Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before May 19, 2020.

If no appeal is filed by this date, the decision is final as issued on March 20, 2020 and the conditions must be fulfilled one year from April 29, 2020.

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

Who can appeal

A notice of appeal can be submitted by:

  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Proposed instrument

The purpose of application 60-C-203262 is to sever a vacant 55.7-hectare portion of land to transfer to the abutting north PIN 42055-0271, a hobby farm on the north half of Lot 3, Concession 5. The hobby farm is currently serviced by a combination of class 1 and 2 sewage systems. The proposed lot addition will provide much needed additional pasture for grazing cows.  No additional development is proposed.  Retained will be a 6.07-hectare property which contains an abandoned shed.
