Decision summary
The Minister of Municipal Affairs and Housing has decided not to revoke a Minister's Zoning Order in the City of Markham, filed as Ontario Regulation 599/21.
Decision details
The Minister of Municipal Affairs and Housing (the Minister) consulted on proposals to potentially revoke, amend, or enhance monitoring of specific zoning orders where limited progress has been made towards implementation of the proposed development. The zoning orders that were identified for consultation are those where the proposed development had made limited progress on either advancing subsequent planning and development approvals or in addressing water and wastewater servicing on the lands subject to the zoning order in a reasonable timeframe to realize the project.
Ontario Regulation (O. Reg.) 599/21 was proposed to be revoked based on limited progress towards ensuring timely access to waste/water servicing. Based on the information received, further progress has been demonstrated and the Minister has decided not to proceed with revoking O. Reg. 599/21. To ensure progress continues to be made towards implementation of this proposed development, Ministry staff will continue to closely monitor its progress. Zoning orders that do not continue to make progress towards implementation may be considered for potential revocation or amendment in the future.
Effects of consultation
The consultation was open for 45 days to provide an opportunity for municipalities, project proponents, stakeholders, and the public to provide feedback and comments. In addition, municipalities, along with project proponents and Indigenous communities, were notified separately by letter. Notification emails were sent to various groups (i.e. municipalities, industry organizations, Indigenous communities) with a link to the ERO posting.
Responses provided the ministry with a detailed account of the work that had been completed thus far and outlined what progress was made related to addressing water and wastewater servicing on the lands subject to the zoning order. The information provided was sufficient to deem that adequate progress had been made in that regard, and therefore, the order has not been revoked.
