On November 29, 2024, the Minister of Municipal Affairs and Housing filed an amendment to Ontario Regulation (O. Reg.) 329/22. The Ministry of Infrastructure requested that the Minister consider making the Zoning Order Amendment.
Decision details
A Zoning Order, made pursuant to clause 47(1) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. The Minister’s Zoning Order Amendment was made at the request of the Minister of Infrastructure.
Ontario Regulation 329/22 permits a transit-oriented community on lands adjacent to the East Harbour Transit Hub. See location map below.
Ontario Regulation 486/24 amends Ontario Regulation 329/22, pursuant to clause 47(8) of the Planning Act, to specify that the City of Toronto’s inclusionary zoning by-law does not apply to the lands subject to Ontario Regulation 329/22, as the developer of the transit-oriented community and the City of Toronto have committed to delivering affordable housing through a separate agreement.
Effects of consultation
All comments received were taken into consideration prior to a decision being made.
Members of the public voiced general concerns around Minister’s Zoning Orders and provincial involvement in a commercial agreement between the developer and the municipality.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the ministry is providing public notice of this request for consultation.
Proposal details
Take notice that the Minister of Municipal Affairs and Housing, under subsection 47(8) of the Planning ActOntario Regulation 329/22. Ontario Regulation 329/22 was made on April 8, 2022, and permits a transit-oriented community on lands adjacent to the East Harbour Transit Hub in the City of Toronto. The request was received from the Minister of Infrastructure.
The proposed amendment would have the effect of ensuring that the City of Toronto’s inclusionary zoning by-law would not apply to the lands subject to Ontario Regulation 329/22, as the developer of the transit-oriented community and the City of Toronto intend to deliver affordable housing through a separate agreement.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision.
