Bulletin summary

An Environmental Compliance Approval (air & noise) has been granted to Lafarge Canada Inc. for the operation of a mobile crushing plant. The equipment will be used to process aggregate throughout the province of Ontario and can potentially operate 24 hour per day.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on original posting date, while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO # 019-1674 for public comment from April 22, 2020 to June 6, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument Decision

An Environmental Compliance Approval (air & noise) has been granted to Lafarge Canada Inc. for the operation of a mobile crushing plant, equipped with one crusher, one screener, a stacker and associated diesel engines. The equipment will be used to process aggregate throughout the province of Ontario and can potentially operate 24 hours per day, seven days per week, and 52 weeks per year.

Contaminant emissions to the air from this facility include total suspended particulate and products of combustion such as nitrogen oxides.

Effects on consultation

Proposals for Environmental Compliance Approval for air and noise (ECA) undergo detailed technical review to determine whether or not they comply with the requirements related to section 9 of the Environmental Protection Act (s. 9 EPA). Approvals are only issued if all of these requirements are satisfied. Submitted proposal satisfies requirements set in section 9 of EPA.

One general comment was received. The comment was reviewed and, where appropriate, was considered in the ministry’s decision whether or not to proceed with this proposal. In this case, the comment is consistent with concerns within the ministry and as a result, terms and conditions have been added.

The terms and conditions do not represent all conditions in the approval, but are those related to the comment on the proposal, such as the minimum separation distance form the facility operations to the receptors.
