Bulletin summary

We are seeking feedback through Ontario’s Regulatory Registry on the development of detailed regulations that would be required to implement the proposed Geologic Carbon Storage Act, 2025 (GCSA ), if it is passed by the Ontario Legislature and receives royal assent.

Why consultation isn't required

We are not required to consult through the Environmental Registry for regulations under Acts that have not been prescribed under the Environmental Bill of Rights (EBR). The proposed GCSA has not been passed by the Ontario Legislature and therefore, it is currently not a prescribed Act under the EBR for which notice of certain regulatory proposals is required.

As part of the proposed regulations that we are considering introducing under the proposed GCSA , if passed, we are also proposing consequential amendments to the regulations under the Oil, Gas and Salt Resources Act (OGSRA). These updates would transition the regulation of special projects involving activities associated with geologic carbon storage, which are regulated by Ontario Regulation 425/23: Special Projects, made under the OGSRA, to the new framework for geologic carbon storage under the proposed GCSA , if passed. We are also considering proposed changes to the sample processing fees established within the Oil, Gas and Salt Resources of Ontario, Provincial Operating Standards, which are strictly financial in nature. We are not required to consult on these changes through the Environmental Registry as they would not have a significant impact on the environment.
