A decision was made on May 19, 2026 to approve, with 54 modifications, the Town of Fort Erie Official Plan, as adopted pursuant to section 17 of the Planning Act by By-law 78-2025. Notice of the Decision was issued on May 19, 2026.
This decision brings into effect updated policies and schedules related to the Fort Erie Official Plan which guides growth and development to 2051.
The adopted Fort Erie Official Plan was reviewed for consistency with provincial policies and conformity with the Planning Act including having regard for matters of provincial interest.
The 54 modifications to the Official Plan have been made to address provincial policy direction related to employment areas, natural heritage and environmental protection, agricultural systems, cultural heritage, Indigenous engagement, and other matters.
Pursuant to subsections 17(36.5) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing to approve an official plan adopted in accordance with section 17 is final and not subject to appeal. Accordingly, the Town of Fort Erie Official Plan, as modified and approved by the Minister, came into effect on May 20, 2025.
Effects of consultation
As a result of public consultation on the Town of Fort Erie Official Plan, the Ministry received a total of 32 comments through the Environmental Registry of Ontario, and 1 additional comment through email to the Ministry.
The comments received through the public consultation process were related to matters including site-specific land use permissions, mapping, environmental policies, development requirements and expansions of the Town’s settlement area boundary.
All submissions the Ministry received were reviewed and considered prior to a decision being made.

Original proposal
Proposal details
On September 5, 2025, the Ministry of Municipal Affairs and Housing received for a decision the Town of Fort Erie’s proposed new official plan (By-law 78-2025), which was adopted by the Town’s municipal council on August 25, 2025.
The More Homes Built Faster Act, 2022 (Bill 23) made changes that resulted in the designation of Niagara Region as an upper-tier municipality without planning responsibilities. This change took effect on March 31, 2025. The Ministry of Municipal Affairs and Housing is now the approval authority for official plans adopted by lower-tier municipalities within Niagara Region.
The new official plan, once approved, will replace the existing plan, which came into effect in November 2011. The new plan is intended to guide growth and development across the Town of Fort Erie to the 2051 planning horizon.
The Ministry will review the matter for consistency and conformity with applicable provincial land use policies and plans. All feedback received will be considered before presenting any potential modifications to the Minister of Municipal Affairs and Housing for a decision in accordance with section 17 of the Planning Act.
