Proposal summary

The Minister of Municipal Affairs and Housing is consulting on two provincially initiated proposed amendments to the Parkway Belt West Plan and the Plan’s associated Minister’s Zoning Order, filed as Ontario Regulation 482/73, for lands municipally known as 2084, 2344, 2460 and 2482 Dundas Street in the City of Burlington, Halton Region.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to regulations and instruments proposed under the Ontario Planning and Development Act, 1994.  

Proposal details

The Ministry of Municipal Affairs and Housing is consulting on two provincially initiated applications to amend the Parkway Belt West Plan and the Plan’s associated Minister’s Zoning Order, filed as Ontario Regulation 482/73, for lands municipally known as 2084, 2344, 2460 and 2482 Dundas Street in the City of Burlington, Halton Region (“the subject lands”). The subject lands are approximately 7.66 hectares in size. 

The subject lands are legally described as part of Lots 16, 17, 19, and 20, Concession 1, South of Dundas Street, designated as part 5 on Reference Plan 20R-22829; parts 1 to 3 on Reference Plan 20R2858; parts 3 & 4 on Reference Plan 20R230; parts 6 & 7 on Reference Plan 20R2858; parts 1 to 3 on Reference Plan 20R4494; and parts 3 to 8 on Reference Plan 20R21920; except for part 7 on Reference Plan 20R22532; part 1 on Reference Plan 20R22532; and parts 1 to 3 on Reference Plan 20R22519; and Parcel Block A-1, Section M197; Blocks A and D on Registered Plan M197; Parcels Block F-1 and G-1, Section M178; Blocks E, F, and G on Registered Plan M178; except part 6 on Reference Plan 20R22519; and part 3 on Reference Plan 20R22531; and Parcel Block 111-1, Section 20M430, Block 111 on Registered Plan 20M430, designated as parts 1 to 4 on Reference Plan 20R-22829, and further identified by Property Identification Numbers 07159-0160 (LT), 07159-0164 (LT), 07159-0192 (LT), 07161-0163 (LT), 07162-0160 (LT), 07162-0156 (LT), 07159-0162 (LT), 07159-0165 (LT), 07161-0006 (LT), 07161-0161 (LT), 07162-0158 (LT), 07159-0158 (LT), and 07162-0154 (LT) registered in the Land Registry Office for the Land Titles Division of Halton (No. 20).

A map of the subject lands is attached below. 

The applications propose to remove the subject lands from the Parkway Belt West Plan and the associated Minister’s Zoning Order to facilitate the future disposition of the lands which have been deemed surplus to government needs. The subject lands are currently designated ‘Utility’ and ‘Public Open Space and Buffer Area’ within the ‘Public Use Area’.

Should the subject lands be removed from the Parkway Belt West Plan and the Minister’s Zoning Order, permitted uses would continue to be subject to the City of Burlington’s Official Plan and Zoning By-law. Any future development on the subject lands would require approval from the City of Burlington.

Other Information

The Parkway Belt West Plan is Ontario’s first provincial land use plan created in 1978 to provide for the development of a multipurpose infrastructure corridor, urban separator, and linked open space system across the Greater Toronto Area. The process to amend the Parkway Belt West Plan is provided in the Ontario Planning and Development Act, 1994. 

Section 17 of the Ontario Planning and Development Act, 1994 authorizes the Minister of Municipal Affairs and Housing (“Minister”) to make an order exercising the powers conferred upon the Minister under clause 47 (1) (a) of the Planning Act, with respect to any land in an area covered by a development plan under section 4 of the Ontario Planning and Development Act

The Minister’s Zoning Order, filed as Ontario Regulation 482/73 under the Ontario Planning and Development Act, was made in 1973 to implement the policies of the Parkway Belt West Plan. The Minister’s Zoning Order generally only permits low impact land uses including agricultural uses, and accessory buildings, and structures that will be used for agricultural operations.
