It must be made clear in the proposed changes to the D-Series Land Use Compatibility Guidelines that setbacks are reciprocal. An application to rezone a site for a new Pit or Quarry or expansion of an existing Pit or Quarry must include a provision for the applicant to provide its own setbacks from existing or permitted sensitive land uses, so that all adverse effects (e.g. fugitive dust, noise, odours, fumes, ground vibrations, airblast, contaminants such as flyrock, loss of well water or contamination of well water, etc.) from aggregate operations are contained on-site. The EPA and the 2020 Provincial Policy Statement define Adverse Effects as one or more of the following:

a) impairment of the quality of the natural environment for any use that can be made of it;
b) injury or damage to property or plant or animal life;
c) harm or material discomfort to any person;
d) an adverse effect on the health of any person;
e) impairment of the safety of any person;
f) rendering any property or plant or animal life unfit for human use;
g) loss of enjoyment of normal use of property; and
h) interference with normal conduct of business.
