This proposed site has the potential of causing many issues. Some of the potential issues are as follows:

1. Potential contamination of ground water and surrounding water bodies (for example Molly’s Creek and Sydenham River). These water bodies hold species at risk and need to be protected from potential environmental impacts leading to destruction of habitat.

Many species at risk inhabit these waterways. The species present in the Sydenham River Watershed for are of the following:

2. Noise pollution for surrounding residential properties from a 24/7 operating schedule. Along with the potential of air pollution from the excessive levels of exhaust from fossil fuel used in the operation of the site. This would cause loss of enjoyment of the local residents property.

Per the definition “adverse effect” defined in the Environmental Protection Act, R.S.O. 1999. S.1(1) of the Environmental Protection Act, R.S.O. 1999; states:

“adverse effect” means one or more of,

(a) impairment of the quality of the natural environment for any use that can be made of it,

(b) injury or damage to property or to plant or animal life,

(c) harm or material discomfort to any person,

(d) an adverse effect on the health of any person,

(e) impairment of the safety of any person,

(f) rendering any property or plant or animal life unfit for human use,

(g) loss of enjoyment of normal use of property, and

(h) interference with the normal conduct of business

Per the definition of “contaminant” defined in the Environmental Protection Act, R.S.O. 1999. S.1(1) of the Environmental Protection Act, R.S.O. 1999 states:

“contaminant” means any solid, liquid, gas, odour, heat, sound, vibration, radiation or combination of any of them resulting directly or indirectly from human activities that causes or may cause an adverse effect.

These activities would be contrary to S.14(1), Environmental Protection Act, R.S.O. 1999.

S.14(1), Environmental Protection Act, R.S.O. 1999 states:

“Subject to subsection (2) but despite any other provision of this Act or the regulations, a person shall not discharge a contaminant or cause or permit the discharge of a contaminant into the natural environment, if the discharge causes or may cause an adverse effect.”
