An amended Environmental Compliance Approval was issued for a 0.19 hectares Waste Disposal Site to be used for:

  1. The collection, sorting, repackaging (consolidation), and transfer of all chemistries, grades, and configurations of intact waste batteries, as defined by Regulation 347; and
  2. The receipt, temporary storage and transfer of Municipal Hazardous and Special Waste (MHSW).

In addition, Nickel Cadmium Wet Cell (UN 2795) batteries will be screened, set aside, and disassembled into their component parts.

The changes proposed to existing operations were:

  1. Increasing the number of intact waste batteries to be received on-site from 100 tonnes/day to 120 tonnes/day;
  2. Increasing the amount of battery waste stored on-site from 300 tonnes to 1100 tonnes; and
  3. Adding Municipal Hazardous and Special Waste (MHSW) storage and transfer to site operations, at 1,300 tonnes of MHSW received/year, 20 tonnes received/day, and 100 tonnes stored on-site at any given time.

The Approval conditions address waste storage, processing and handling procedures, spills and emergency response and reporting procedures, including the implementation of a fire safety plan in concurrence with the local fire department. In addition, the following are reviewed and address through Approval conditions: signage and site security, inspection of incoming waste and refusal, nuisance control, site inspection, worker training, complaints, record keeping, reporting, site closure.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

This proposal is for an amendment to Environmental Compliance Approval (waste disposal site) No. 3952-BAUPEG for the use and operation of an existing private waste transfer and waste processing facility, presently used for the processing and transfer of intact waste batteries, taking place inside a 1,900 square metres facility, located within a 11,500 square metres building at at 701 Brook Road North, Unit 8 in the Town of Cobourg, Ontario.

Intact waste batteries will continue to be received, sorted, and repacked and consolidated for shipment at the site. In addition, Nickel Cadmium Wet Cell batteries will continue to be screened, set aside, and disassembled into their component parts for other users.

Under this application, it is proposed that site operations include the storage and transfer of Municipal Hazardous or Special Wastes. The Municipal Hazardous or Special Wastes to be received will not be processed at the site; these materials will be transferred to offsite recycling facilities.

The total maximum amount of waste received at the site will be 120 tonnes per day, with a proposed maximum storage capacity increase to 1,200 tonnes at any one time. The site will service Canada and the United States of America, and will be operated 24 hours a day, Monday to Sunday. Shipping and receiving hours for the site will be from 7:00 am to 8:00 pm, Monday to Friday.
