An amendment approval is granted to amend the existing Environmental Compliance Approval (processing) A-500-1210926002 for NORFOLK DISPOSAL SERVICES LIMITED to operate a facility located at 811 Old Highway 24, Waterford, Ontario. The amended approval includes the following:
- approval for the receiving, bulking and transfer of source separated organics including residual food waste from the curb side collection of green bins
- the facility is to receive a daily average between 12 and 20 tonnes of source separated organics per day
- all organics collected will be transferred to an off-site facility for composting
- the facility will be open to the public Monday to Friday seven a.m. to five p.m. and Saturdays seven a.m. to one p.m
The approval requires the proponent to apply and seek section nine (odour), Environmental Protection Act, approval within 60 days of the issuance of this Approval.

A summary of comments along with our response is provided below:
- in complete communication with the affected neighbors
Response: As per proposal, the proponent notified 14 neighboring properties. In addition, the ministry posted the proposal on the Environment Registry of Ontario (ERO) for 45 days for public/stakeholders input besides Application Assessment Unit (AAU) sent a notification to the municipality for input. Given that the site is an existing waste disposal site with a valid waste disposal site approval, and no increase in the site capacity, public consultations completed for this ECA amendment is deemed have met the public consultation requirements.
- odour associated with SSO and potential impact on the neighbour
Response: Condition is included in the approval requiring the proponent to apply and seek section nine, (odour), EPA, approval, within 60 days of the issuance of this amendment approval.
- nuisance related to rodent and pest control
Response: A condition (condition 19) is included in the approval requiring the proponent to operate the site in such a way to prevent adverse impact including nuisance impact. Moreover, SSOs are to be loaded and unloaded indoor and requires removal within 48 hours of its receipt. In case of concerns, a complaint mechanism (receipt, investigation and response) is part of the approval. In our opinion, adequate safeguards are included in the approval to address the nuisance related concerns.
- has a new environmental study completed to assess impact related to the current proposal
Response: There was no regulatory requirement for the environmental impact assessment study for the proposed undertaking.
- increased risk of traffic congestion and accident due to increased truck traffic
Response: The approval does not involve increase in incoming waste capacity. In fact, the incoming waste capacity remains the same but Source Separated Organic (waste type) is being added to the already approved waste type. As such, an increase in truck traffic is not expected.
- devaluation of the property value
Response: This is an approved waste disposal site instead of a new waste disposal facility. That said, this matter is deemed beyond the scope of this engineering evaluation.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal
