On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1660 for public comment from April 15, 2020 to May 15, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

On May 10, 2022 the ministry filed a certified amendment for the Bell Creek Facility site, located in in Hoyle Township in the District of Cochrane, approximately 13 kilometers (km) northeast of Timmins, Ontario.
This amendment will allow the company incorporate the contiguous Marlhill Mine site into the Closure Plan boundary of this site, as well as the Polishing Pond expansion, submitted in April of 2018 and the Phase four Mini Dyke Raise, submitted in January of 2019.

Effects of consultation:
No comment was received through the Environmental Registry of Ontario resulting in no impact on the decision to proceed or not with this proposal.
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak which exempts all proposals from the requirement to post notices on the ERO. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
