A decision was made to approve Official Plan Amendment #17(OPA #17) on November 6, 2020, subject to two modifications. The effect of the amendment will be to expand the area and permitted uses of the Calabogie Motorsports Park. The last day that this decision can be appealed is December 2, 2020.

OPA #17 seeks to re-designate approximately 242.82 ha (600 acres) of land from "Rural", "Mineral Aggregate" and "Environmental Protection" to "Rural-Exception Five" and "Environmental Protection", as well as expand the permitted uses within the Rural-Exception Five designation.

The proposed new or expanded uses are:

  • 36 villas with garages
  • garage/automobile storage buildings
  • 2500 sq. ft. clubhouse facility
  • staff parking area
  • viewing/parking area for a max of 3000 spectators
  • commercial and garage development
  • recreational trails
  • the use of public address systems

Modifications to OPA 17 were made to ensure consistency with the PPS 2020. Modifications were made to address relevant Provincial interests related to on-site private servicing and the identification and protection of Provincially Significant Wetlands and habitat of endangered and threatened species. Specifically, modifications were made to ensure demonstration of no-negative impacts on groundwater quality/quantity as a result of the increased reliance on private servicing (PPS policy 1.6.6.4); the identification and protection of Provincially Significant Wetlands (PSWs) from any incompatible development (PPS policies 2.1.4 a) & 2.1.8) and the appropriate permitting of development in the habitat of endangered and threatened species in accordance with (PPS policy 2.1.7).

The last day that this decision can be appealed is December 2, 2020.

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario
