Approval was granted for a new Environmental Compliance Approval (Air) for Li-Cycle Corp., a lithium battery recycling facility located in Kingston, Ontario. The approval includes combustion equipment, emission control equipment, and the receipt, storage, treatment, and transfer of lithium batteries.

Pourquoi une consultation n’est pas nécessaire

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on May 29, 2020, while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1820 for public comment from May 29-June 13, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details

This approval is for a new Environmental Compliance Approval (Air) for Li-Cycle Corp., a lithium battery recycling facility located in the City of Kingston, Ontario.

This application includes all emission sources from the facility that exhaust to the atmosphere including combustion equipment, emission control equipment, and the receipt, storage, treatment and transfer of lithium batteries.

Contaminant emissions to the atmosphere include:

  • ethyl methyl carbonate
  • ethylene carbonate
  • calcium oxide
  • suspended particulate matter
  • noise

This proposal was submitted in conjunction with Waste Disposal Site - Ministry Reference Number 3456-BP6PDU (ERO Number 019-1820).

Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
