We have renewed Permit To Take Water Number No. 7727–88EHF7 for industrial purposes for Goldcorp Canada Ltd., located at the Musselwhite Mine, approximately 130 kilometres north of the town of Pickle Lake and approximately 470 kilometres northwest of Thunder Bay.

Pourquoi une consultation n’est pas nécessaire

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin as because the proposal was posted on April 28, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consulted with the public on this proposal by posting ERO# 019-1710 for public comment from April 28, 2020 - May 28, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Decision Details:

Permit To Take Water Number No. 7727–88EHF7 was renewed and issued to Goldcorp Canada Ltd. for industrial purposes. Water will be taken from two (2) wells for the operation of a Cement Rock Fill Plant at the Musselwhite Mine, located approximately 130 kilometres north of the town of Pickle Lake and approximately 470 kilometres northwest of Thunder Bay.

Source of water: well (CFP-PW1)

  • purpose of taking: industrial - cement backfill
  • maximum rate per minute (litres): 450
  • maximum number of hours of taking per day: 24
  • maximum volume per day (litres): 650,000
  • maximum number of days of taking per year: 365
  • period of taking: January 1 to December 31 for 10 years

Source of water: well (CFP-PW2)

  • purpose of taking: industrial - cement backfill
  • maximum rate per minute (litres): 450
  • maximum number of hours of taking per day: 24
  • maximum volume per day (litres): 650,000

Effects of Consulation:

The comment received identified concern with the posting under Ontario Regulation 115/20. The comment was considered, and information on why consultation isn't required is provided in the above section.

Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect. On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak which exempts all proposals from the requirement to post notices on the ERO. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
