Pourquoi une consultation n’est pas nécessaire
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.
Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin as because the proposal was posted on April 9, 2020 while Ontario Regulation 115/20 was in effect.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO #019-1616 for public comment from April 9, 2020 - May 24, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision
An environmental compliance approval (air and noise) has been issued to 1499545 Ontario Inc., a mobile construction and demolition material grinding and shredding facility operating throughout the Province of Ontario.
This approval includes all emission sources from the facility that exhaust to the atmosphere including one tub grinder, one excavator, and one shredder.
Contaminant emissions to the atmosphere include carbon monoxide, particulate matter, nitrogen oxides, and noise.

Effects of consultation
The ECA will contain operational terms and condition to regulate the facility’s operations. Moreover, the facility will be required to maintain setback distances that will ensure compliance with ministry emission standards and noise limits at the nearest receptors. The ministry emission standards and noise limits are protective of the environment.
Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
