The subject lands are located on Two Island Lake, approximately 17.4 kilometres north of the City of Thunder Bay municipal boundary. The subject lands are accessed by Two Island Lake Road which is maintained on a seasonal basis by the Jacques Local Roads Board.

Application 58-C-193026 for the creation of a new lot on Two Island Lake was refused.
Based on Ministry of Environment, Conservation and Parks (MECP) Lake Partner Program (LPP) data available for Two Island Lake from 2005 until 2019, the average total phosphorus (TP) concentration in the lake has been slowly increasing over the period of record, from ice-free total phosphorus lake average concentrations of 7.9ug/L in 2005-2007, to 8.0ug/L in 2010-2011, and 8.3ug/L in 2018-2019.
The increasing trend in TP concentrations suggests that there is little or no development capacity remaining on the lake. Development on the lake must not result in the total phosphorus concentration exceeding the PWQO value of 10ug/L. Given the current TP concentrations and trends in Two Island Lake, the Province indicated that lake capacity modelling was required to assess if the lake can sustain development on the two proposed undersized lots.
To date, no documentation has been included to indicate whether Two Island Lake has capacity for the creation of additional lots. As such, based on available evidence, the application is not consistent with section 2.2.1 h) of the Provincial Policy Statement 2020 and has been refused.
Effets de la consultation
The Ministry posted a notice in the local newspaper the Thunder Bay Chronicle Journal on April 14, 2021 inviting the public to comment. Comments were received as a result of the newspaper posting related to the proposed use of the property for resource-based recreational use. No comments related to lake capacity were received. Concerns related to land use could be resolved by conditions, and therefore did not impact the decision. No comments were received as a result of the ERO posting.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Proposal Details
The purpose of this early-consultation application is for the creation of one (1) new lot for resource-based recreational purposes by severing PIN 62327-0320 (main property) and PIN 62327-0321 (shoreline reserve) in the Unincorporated Township of Jacques, District of Thunder Bay. The subject lands are located on Two Island Lake, approximately 17.4 kilometres north of the City of Thunder Bay municipal boundary. The subject lands are accessed by Two Island Lake Road (via Ontario Highway 589) which is maintained on a seasonal basis by the Jacques Local Roads Board.
The proposed severed lot would be approximately 0.447 hectares with 50.75 metres of roadway frontage and 51.7 metres of shoreline frontage and a depth of 86.10 metres. The proposed retained lot would be approximately 0.459 hectares with 56.32 metres of roadway frontage and 51.7 metres of shoreline frontage and a depth of 87.00 metres.
