The application for consent, 58-C-216186 is draft approved subject to standard conditions. The applicant has one year to satisfy conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before August 19, 2021.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

- the specific part, or parts of the official plan amendment that you wish to appeal
- the reasons for your appeal
- the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

The Ministry has received applications 58-C-216186, 58-C-212983 and 58-C-213127 for the creation three (3) easements.
The purpose of application 58-C-216186 (this application) is to create an easement over Mining Claim TB3831 to benefit Lot 5 on plan 55M-638. The proposed access is approximately 10 metres wide, and 342 metres in length. The land subject to the easement is approximately 10 hectares while the land benefiting and receiving the access easement is approximately 0.343 hectares. The retained lands are proposed to remain vacant and heavily forested, while the lands benefiting from access are used for resource-based recreational use.
Easement application 58-C-212983 is described under ERO No. 019-3620 and application 58-C-213127 is described under ERO No. 019-3622 . The combined effect of applications 58-C-216186, 58-C-212983 and 58-C-213127 is to assist in the creation of legal road access for Lots 4, 5 and 6 on Plan 55M-638 which are resource-based recreational properties on Windigoostigwan Lake.
