The subject lands are on Lac Des Mille Lac near the Seine River/Lac Des Mille Lac dam over 160 kilometres west of the central area of the City of Thunder Bay. The subject lands are accessed by Blind Bay Road, a Crown forestry road.

The application for consent 58-C-206652 was draft approved with modifications on December 9, 2021 subject to conditions. The modification was to increase the proposed new lot from .8 ha to 1 ha in order to meet the Ministry of the Environment, Conservation and Parks size requirement.
The application was reviewed for consistency with the environmental policies of the Provincial Policy Statement (e.g. natural heritage, water quality protection). No public comments were received, and conditions were added to address partner ministry concerns relating to public health and safety, cultural archaeology, water quality, and wildland fire hazard.
No concerns related to fish or wildlife habitat, species at risk, or protected areas were identified in relation to this application. Given the existing use of this proposal and the absence of known natural heritage features in the area, there will be no negative impacts to greenspace, and natural heritage.
The following conditions were added:
To ensure the use of the new lot will not change and will remain as a commercial resort operation and therefore not requiring a Record of Site Condition to permit a more sensitive use per the Environmental Protection Act, an agreement registered on title will be required to limit the use to commercial uses only and to prohibit a single recreational use.
To protect human health and the environment, a letter from a sewage hauler confirming that the approved sewage disposal facility has sufficient reserve capacity to accept hauled sewage from the new lot; and a report from the Thunder Bay District Health Unit indicating that the lots have been inspected and are suitable for a new sewage system and/or that the existing systems meet their requirements.
To protect and conserve an area of archaeological potential, the assessment submitted to the Ministry of Heritage, Sport, Tourism, Culture and Industries has been entered into the Public Register of Archaeological Reports.
To protect water quality and to maintain the naturalization of the shoreline, confirmation from the Ministry of Northern Development, Mines, Natural Resources and Forestry (NRF) district office that the unauthorized structure located on the Crown shoreline reserve has been resolved to their satisfaction.
To direct development to the areas outside of the lands that are unsafe for development due to the presence of hazardous forest types for wildland fire, a Wildland Fire Assessment that includes mitigation techniques is submitted and reviewed by the Ministry of Northern Development, Mines, Natural Resources and Forestry (NRF).
The decision to approve the consent is consistent with the Provincial Policy Statement once conditions are met. This decision will not have a significant impact on the environment.
The applicants have one year to satisfy conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before December 29, 2021.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:

- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Proposal Details
This Ministry has received Application 58-C-206652 for the creation of one (1) new lot for resource-based recreational uses (Seine River tourist resort) and the creation of one (1) easement for access. The purpose of the application is to sever PIN 62505-1466 on Lac Des Mille Lac in the Unincorporated Territory, District of Thunder Bay, and to create an easement over the proposed severed lot to the retained lot.
The proposed severed lot would be approximately .8 hectare with 93.8 metres of frontage and a depth of 167.6 metres. The proposed retained lot would be approximately 1.64 hectares with 182.7 metres of lake frontage and a depth of 163.5 metres. The proposed easement would be 101.5 metres long and 6 metres wide with the servient lands being the proposed severed lot to access the dominant lands, the proposed retained lot.
The subject lands are on Lac Des Mille Lac and the Seine River. The subject lands are accessed by Blind Bay Road, a Crown forestry road. A portion of the subject lands are within the Lac Des Mille Lacs Enhanced Management Area (E2280r).
