I am writing to raise concerns re: Bill 197 and enhanced powers granted the Minister under The Planning Act through Minister's Zoning Orders (MZ0) More specifically, I would request that the Minister of Municipal Affairs and Housing (The Minister) address the potential for misuse of this authority in the case of The City of Stratford, The County of Perth, and the Township of Perth South to promote the Xinyi float glass plant in Stratford. There have been substantive concerns raised in letters to The Minister as recently as January 21, 2021. For full disclosure, I am a resident of Stratford and oppose the means by which the proposed Xinyi plant has been allowed to progress.
While I do not disagree with the general intent of Bill 197 to implement projects such as affordable housing, The Minister's authority should not and must not disregard community concerns PRIOR TO THE MZO being implemented. Sadly, Bill 197 encourages a 'top-down' planning approach and secrecy in what would otherwise be an open, transparent process under The Planning Act. Stratford's Official Plan and Zoning process have been completely circumvented through the existing MZO for the Xinyi glass plant. Moreover, in their efforts to find out more about a process that appears to have taken place without meaningful public input, those opposed to the plant have been advised by the City of Stratford to submit Freedom of Information Requests!
Finally, the authority of The Minister to require Site Plan agreements and impose further Amendments to an existing MZO under Bill 197 reinforces a very heavy hand in planning matters.
I would ask that The Minister seriously consider revocation of the Xinyi/Stratford MZO and ensure that changes are made to Bill 197 to ensure that open and transparent consultation is undertaken with affected communities BEFORE an MZO is put in place. Otherwise, the power of the Province is open to flagrant abuse.
