This act puts an unnecessary burden on our company. While the purpose of the act to ensure topsoil is reused and not disposed of is great, it’s requirements are cumbersome and don’t reflect the realities of our sector. At times we do many small topsoil jobs in a day as part of our sodding for the city/municipality. This entails taking out sand/topsoil put down after a repair maybe 1 - 2 yard3 and replacing it with better topsoil and sod. The old sand/dirt is put in a truck and at end of day the whole days removal is put into a pile at our shop. The pile itself would be run through a shredder to remove large debris, mixed with other topsoil and reused in our landscaping work later. Requiring us to get permission from each home owner is arduous since most are not even home at the time. Trying to keep each batch of topsoil separate is also costly as we would need to find a way to either bag it or put in separators, and running each load back to our shop is not feasible. There should be an exemption for an amount of say 5 yard3 or less.
