Bill 185 proposes a new section 62.0.2 to the Planning Act which would have the effect of exempting publicly-assisted universities and affiliated colleges from the Planning Act and sections 113 and 114 of the City of Toronto Act. As a supplementary submission to the Province’s ERO, please accept this letter highlighting the City’s concern with respect to the new section 62.0.2 of the Planning Act.

The City is concerned that the recently filed Minister Zoning Order (O. Reg. 10/24) related to hospital helicopter flight paths would be overridden by any “undertakings” proposed by publicly-assisted universities and affiliated colleges. Through Bill 185, these “undertakings” are proposed to be exempt from sections of the City of Toronto Act and Planning Act (under which certain MZOs were filed).

Should Bill 185 receive Royal Assent as proposed, “undertakings” of publicly-assisted universities and affiliated colleges proposed to be located under established hospital helicopter flight paths have the potential to jeopardize public health and safety.

• The City requests that the Province modify Bill 185 to ensure that MZOs filed under the Planning Act would continue to apply to any “undertakings” of publicly-assisted universities and affiliated colleges.
