Approval for the establishment of Works for the Green Infrastructure Partners Inc., in support of quarry dewatering and stormwater management to include a sump pond to collect surface water and ground-water seepage from open excavation areas from a catchment area of 77 hectares, to provide water quality protection and quantity control prior to discharge via a pumping system in the quarry sump and the associated piping to convey quarry sump water away from the quarry excavation, discharging towards the forested wetland flowing into Cody Creek of Mississippi River and ultimately into Ottawa River, for all storms events up to and including the 100-year return storm, consisting of the following:

Stormwater Management System:

One retention/detention Sump, located at the south-west edge of the boundary area on a foot print of 1350 square metres, with a three metres deep dead storage volume of 4,050 cubic metres for sediment accumulation and process usage, a six metres deep permanent pool volume of 8,100 cubic metres and one metres deep active pumping volume of 1,350 cubic metres; totalling to 13,500 cubic metres volume of water; to discharge effluent at a maximum allowable pumping rate of 238 litres per second into a forested wetland flowing into the Cody Creek of Mississippi River and ultimately into Ottawa River;

  • the retention/detention sump is provided with a 450 millimetres diameter, six metres long HDPE overflow pipe for effluent discharge on a 500 millimetres deep flow dissipation riprap apron with a varied width of 1.5 metres to 7.0 metres, located at the end of the effluent discharge overflow pipe
  • A low-head rock check dam or a straw bale check dam is to be constructed across the flow pathway immediately upstream of the receiver wetland

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for a new Environmental Compliance Approval (industrial sewage) to be issued to West Carleton Sand & Gravel Inc., in support of quarry dewatering systems and sewage works as part of Burntlands Quarry facilities located on Part of Lots 16 and 17, Concession XII, Geographic Township of Ramsay, Mississippi Mills, Ontario.

The proposed sewage works for the Burntlands Quarry include a sump pond to collect surface water and groundwater seepage from open excavation area, a pump in the quarry sump and the associated piping to convey quarry sump water away from the quarry excavation, discharging towards the Cody Creek, and ultimately to the Mississippi River and Ottawa River.
