The last day this decision can be appealed is December 30, 2020.

56-C-200496 was approved on December 10, 2020 with conditions. This approval will facilitate the transfer of mining lands described as PIN 65379-0185 (LT) and PIN 65379-0186 (LT) from one company to another for continued use for mineral exploration. This application is related to applications 56-C-200616 and 56-C-204126 which also propose to sever mining lands in the same area for the same use and purpose. The lands to be retained in this transaction are outlined in green on the sketch (attached to this decision notice), the lands to be severed by this application and the two related applications are outlined in pink.

These lands are currently vacant, no new development or site alteration is proposed as a result of this application. The parcel severed in this application has approximately 409 metres of frontage on either side of Highway 101. There is no existing access and no immediate plans to construct an access, but the application indicates that the lands would be accessed via Highway 101. A reciprocal easement will also be registered on the severed and retained lands in both applications for the purposes of ensuring access.

The application was reviewed for consistency with the environmental policies of the Provincial Policy Statement (e.g. natural heritage, water quality protection). No public comments were received or concerns identified related to environmental policies. The decision to approve the consent is consistent with the Provincial Policy Statement, this decision will not have a significant impact on the environment.

The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Local Planning Appeal Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before December 30, 2020.

The proponent will have one (1) year to satisfy conditions, otherwise approval will lapse.

Non-standard conditions include:

  • That an easement for the purpose of ensuring access for the severed and retained lands be registered together with the transfer.

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Description of instrument

Application number 56-C-200496 would sever mining lands described as PIN 65379-0185 (LT) and PIN 65379-0186 (LT) in order to facilitate the transfer of these lands from one company to another. The lands to be severed are approximately 33.48 hectares in size. This application is related to applications 56-C-204126 and 56-C-200616 which also propose to sever mining lands in the same area. The lands retained following all three proposed severances are approximately 161.42 hectares in size and are outlined in green on the attached sketch.

The subject land is currently vacant, no new buildings or structures are proposed as a result of these applications. The proposed severed and retained lands subject to these applications are all currently used for mining exploration and would continue to be used for mining exploration. PIN 65379-0186 (LT) has approximately 818 metres of frontage on Highway 101 and is proposed to be used as a point of access for the severed and retained lands. These applications would also serve to create an easement to provide access to the highway over the severed and/or retained lands. Much of the land surrounding the subject property is also used for mining exploration activities.

Appeal of a decision of the Minister in respect of this consent may be made by any person or public body not later than 20 days after notice of the decision is given. If you wish to be notified of the decision of the Minister in respect of the proposed consent, you must make a written request to the Minister at the contact address.

As required under the Planning Act, a public notice will be published in the Iroquois Falls Enterprise in English and French.
