The Donovans in Gogama, Noble Township, District of Sudbury applied to separate PINs 73143-0251, -0266, and -0035 from the PINs 73143-0264 and -0253 after the lots merged on title. The last day this decision can be appealed is July 8, 2019.

Decision on instrument

Application 52-C-180416 was approved on June 18, 2019 with conditions. A new owner of the severed lot will run the commercial lodge and campground. Jim and Joanne Donovan will continue to use the retained lot for residential purposes. There are no new buildings, services, or other developments planned.

The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Local Planning Appeal Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before July 8, 2019.

Jim and Joanne Donovan have one (1) year to satisfy conditions, otherwise approval will lapse.

Non-standard conditions include:

  • The Ministry of Municipal Affairs and Housing is to be advised in writing by the transferor that the Offer of Purchase and Sale agreement, or alternatively an acknowledgement by the transferor and transferees, contains the following clauses:

“Shoreline best practices include:

  1. Avoiding development next to the shoreline for a minimum of 30 metres and maintaining vegetation along the shore and around the property;
  2. Using grassed swales and/or vegetated filter strips on lots that require ditching to control runoff;
  3. Directing roof leaders to rear yard ponding areas, soakaway pits or rain barrels;
  4. Directing sump pump foundation drains to rear ponding areas and infiltration trenches”

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Application No. 52-C-180416 would sever approximately 2.55 hectares being PINs 73143-0251, 73143-0266, and 73143-0035 (Part 2 on plan 53R-7912, Part 1 on 53R-15023, and Summer Resort location LG-107 and WB-75) from the abutting 0.3-hectare property being PINs 73143-0264 and 73143-0253 (Summer Resort location RF-62 and Part 1 on Reference Plan 53R-12917 as well as Part 1 on Reference Plan 53R-7912).

The proposed severed lot will continue to be run as a commercial lodge and campground while the retained lands will continue to be used for residential purposes. There are no new buildings, services, or infrastructure developments proposed.
