Decision details
The Minister of Municipal Affairs and Housing (the Minister) consulted on proposals to potentially revoke, amend, or enhance monitoring of specific zoning orders where limited progress has been made towards implementation of the proposed development.
The zoning orders that were identified for consultation are those where the proposed development had made limited progress on either advancing subsequent planning and development approvals or in addressing water and wastewater servicing on the lands subject to the zoning order in a reasonable timeframe to realize the project.
Ontario Regulation (O. Reg.) 159/22 was proposed to be revoked based on limited progress being made on the subsequent approvals needed for project implementation. On January 23, 2024, Kingston City Council supported the revocation of O. Reg. 159/22 through a council resolution COU-24-053.
With the filing of O. Reg 165/24, O. Reg. 159/22 has been revoked and the site is now fully subject to the in effect applicable municipal zoning by-laws.
Effects of consultation
The consultation was open for 45 days to provide an opportunity for municipalities, project proponents, stakeholders, and the public to provide feedback and comments. In addition, municipalities, along with project proponents and Indigenous communities, were notified separately by letter. Notification emails were sent to various groups (i.e. municipalities, industry organizations, Indigenous communities) with a link to the ERO posting.
Responses provided the ministry with information about implementation progress on this site. This information was reviewed against the original criteria for assessing whether limited progress has been made towards the implementation of the proposed development, and on that basis the Minister decided to proceed with revoking this zoning order.

Proposal details
Take notice that the Minister of Municipal Affairs and Housing, under subsection 47(8) of the Planning Act, is consulting on a proposal to revoke a Zoning Order in the City of Kingston, filed as Ontario Regulation 159/22.
Ontario Regulation 159/22 applies to the lands identified on Reference Map No. 283 (see attached below). The lands subject to the Zoning Order are approximately 32 hectares (80 acres) in size, and located at 2800 and 3001 Clogg's Road.
A Zoning Order regulates the use of land and the erection, location and use of structures on the land. Ontario Regulation 159/22 provides direction on the land uses and associated development standards permitted within the Subject Lands.
